Abstract

El Mintransporte, emprendió un proyecto de interoperabilidad, y otorgó fecha límite marzo de 2019, sin embargo, amplió el plazo por un año más a los 174 peajes. El estudio tiene objetivo responder la pregunta: ¿Cuál será la relación entre las obligaciones contractuales y las especificaciones técnicas y funcionales definitivas frente al no cumplimiento de las resoluciones, 4303 de 2015 y 546 de 2018; las cuales vencieron en marzo de 2019, para la implementación del sistema IP/REV y obtener la certificación como operador para las concesiones viales en Colombia? Se justifica pues el producto agrega valor y beneficia a los stakeholders para conocer los ítems principales que dan origen al incumplimiento y hacerlo parte de la solución para lograr el objetivo del proyecto. El referente teórico se centró sobre las Obligaciones Contractuales, la Normatividad como Leyes 80/1993 y 1508/2012 y modelos de contratos suscritos, adicionalmente los antecedentes, y requerimientos técnicos definidos por el Mintransporte para el IP/REV. Este estudio es no experimental, cuantitativo, y transversal, el cual arrojó la correlación más alta de 0.9919. El Ministerio debe articular las obligaciones contractuales y las especificaciones técnicas y funcionales del IP/REV para Colombia, de lo contrario el proyecto no será implementado al 100%.

The Mintransport, undertook an interoperability project, and granted a deadline of March 2019, however, extended the term for one more year to the 174 tolls. The objective of the study is to answer the question: What will be the relationship between the contractual obligations and the definitive technical and functional specifications in the face of non-compliance with resolutions, 4303 of 2015 and 546 of 2018; which expired in March 2019, for the implementation of the IP / REV system and obtain certification as operator for road concessions in Colombia? It is justified because the product adds value and benefits the stakeholders to know the main items that give rise to the breach and make it part of the solution to achieve the objective of the project. The theoretical referent focused on the Contractual Obligations, the Normativity as Laws 80/1993 and 1508/2012 and models of contracts subscribed, in addition the antecedents, and technical requirements defined by the Mintransport for the IP / REV. This study is non-experimental, quantitative, and cross-sectional, which yielded the highest correlation of 0.9919. The Ministry must articulate the contractual obligations and the technical and functional specifications of the IP / REV for Colombia, otherwise the project will not be implemented at 100%.
